By using this website, submitting an enquiry, requesting a safari quotation, confirming a booking, or communicating with BushTracker Safaris, you agree to these Terms of Service. If you do not agree with these terms, please do not use our website or services.
1. About BushTracker Safaris
BushTracker Safaris provides safari planning, guided safari experiences, travel coordination, itinerary design, and related tourism services in Kenya and East Africa. Our services may include wildlife safaris, private tours, lodge-based safaris, transfers, excursions, and tailor-made travel experiences.
We aim to provide accurate travel information and well-planned safari experiences, but all travel arrangements remain subject to availability, seasonal conditions, park regulations, supplier terms, weather, safety considerations, and other factors outside our control.

You agree not to use the website for unlawful purposes, fraudulent enquiries, malicious activity, copying our content without permission, attempting to interfere with website security, or misrepresenting your identity.
3. Safari Information and Website Content
We work to keep the information on our website accurate and up to date. However, safari prices, itineraries, accommodation availability, park fees, transfer options, and travel conditions may change without prior notice.
Images, descriptions, routes, wildlife references, accommodation details, and destination information are provided for general guidance. Wildlife sightings are never guaranteed, as safari experiences depend on nature, seasonality, animal movement, weather, park conditions, and guide judgement.
4. Enquiries and Quotations
Submitting an enquiry through our website, email, WhatsApp, phone, or contact form does not create a confirmed booking. A booking is only confirmed once:
A final itinerary has been agreed;
The applicable deposit or full payment has been received;
BushTracker Safaris has issued written booking confirmation.
Any quotation provided is based on the information available at the time of enquiry. Quotes may change due to accommodation availability, exchange rates, government fees, park fees, supplier rates, seasonal pricing, transport costs, or changes requested by the client.
5. Booking Confirmation and Payments
To confirm a safari booking, we may require a deposit or full payment depending on the itinerary, travel dates, accommodation partners, and supplier requirements.
Payment terms will be shared with you before confirmation. Failure to pay the required amount by the stated deadline may result in cancellation of the booking or release of reserved accommodation and services.
All bank charges, transfer fees, card fees, mobile money charges, currency conversion costs, or intermediary payment charges are the responsibility of the client unless otherwise stated in writing.
6. Pricing and Inclusions
Safari prices may include some or all of the following, depending on the confirmed itinerary:
Accommodation
Meals as specified
Ground transport
Game drives
Professional guide services
Park or conservancy fees
Airport transfers
Excursions or activities listed in the itinerary
Unless expressly included in writing, prices may exclude:
International flights
Visas
Travel insurance
Vaccinations or medical expenses
Tips and gratuities
Personal expenses
Optional activities
Alcoholic drinks
Laundry
Additional meals or drinks
Passport fees
Changes requested after confirmation
The final inclusions and exclusions will be clearly stated in your confirmed itinerary or quotation.
7. Cancellations by the Client
If you cancel a confirmed booking, cancellation charges may apply. These charges depend on the cancellation date, supplier policies, accommodation rules, park fee policies, and the costs already committed on your behalf.
Some lodges, camps, airlines, transport providers, and activity suppliers may apply strict cancellation policies, especially during peak travel seasons. Any non-refundable payments made to suppliers may not be recoverable.
A cancellation must be submitted in writing by email or another approved communication channel. The cancellation date will be the date on which BushTracker Safaris receives written notice.
8. Changes by the Client
If you request changes to your confirmed itinerary, we will do our best to accommodate them. Changes may be subject to availability, supplier approval, additional costs, cancellation charges, or revised travel conditions.
Changes may include revised travel dates, accommodation upgrades, route adjustments, added activities, changed passenger numbers, dietary requests, or transport modifications.
BushTracker Safaris is not responsible for costs caused by late changes requested by the client.
9. Changes or Cancellations by BushTracker Safaris
We reserve the right to make reasonable changes to an itinerary where necessary due to safety concerns, weather, road conditions, park rules, accommodation changes, supplier issues, government restrictions, force majeure events, or other circumstances beyond our control.
Where possible, we will offer a suitable alternative of similar value. If a major change is required, we will communicate with you as soon as reasonably possible.
10. Travel Documents and Client Responsibilities
Clients are responsible for ensuring that they have valid passports, visas, travel permits, vaccination certificates, health documentation, travel insurance, and any other documents required for travel.
You are also responsible for providing accurate personal details, travel dates, dietary requirements, medical conditions, mobility limitations, emergency contacts, and any information that may affect your safari experience.
BushTracker Safaris is not liable for costs, losses, denied entry, missed services, or travel disruption caused by incomplete, inaccurate, or invalid travel documentation.
11. Travel Insurance
We strongly recommend that all travellers purchase comprehensive travel insurance before confirming a safari. Insurance should cover medical emergencies, evacuation, trip cancellation, baggage loss, travel delays, personal liability, and safari-related risks.
BushTracker Safaris is not responsible for losses that could have been covered by appropriate travel insurance.
12. Health, Safety and Safari Conduct
Safari travel may involve remote locations, wildlife areas, uneven terrain, long drives, changing weather, and limited medical facilities. You agree to follow the instructions of guides, lodge staff, park rangers, and authorised personnel at all times.
Clients must not feed wildlife, leave vehicles where prohibited, ignore guide instructions, damage natural environments, harass animals, litter, or engage in behaviour that endangers themselves, other travellers, wildlife, staff, or local communities.
BushTracker Safaris may refuse service or remove a client from an activity if their conduct creates a safety risk or disrupts the experience for others.
13. Wildlife and Nature Disclaimer
Safari experiences take place in natural environments. While our guides and partners work hard to create memorable wildlife experiences, animal sightings, migration movements, weather conditions, landscapes, road access, and park experiences cannot be guaranteed.
No refund will be issued solely because a specific animal, event, landscape condition, or wildlife sighting was not experienced.
14. Third-Party Suppliers
Some services may be provided by third parties, including lodges, camps, airlines, transport companies, park authorities, restaurants, activity providers, and local partners.
BushTracker Safaris carefully selects partners, but we are not responsible for the independent acts, omissions, policies, delays, changes, or failures of third-party suppliers, except where required by applicable law.
15. Limitation of Liability
To the fullest extent permitted by law, BushTracker Safaris will not be liable for indirect, incidental, special, or consequential losses, including loss of enjoyment, lost profits, missed connections, travel delays, emotional distress, or costs caused by circumstances beyond our reasonable control.
Our liability, where legally established, will be limited to the amount paid directly to BushTracker Safaris for the affected service.
16. Website Intellectual Property
All website content, including text, images, graphics, layouts, logos, itineraries, destination descriptions, and other materials, belongs to BushTracker Safaris or its licensors unless otherwise stated.
You may not copy, reproduce, republish, modify, distribute, or commercially use our content without written permission.
17. Links to Other Websites
Our website may contain links to third-party websites such as accommodation providers, conservation partners, payment platforms, maps, review platforms, or travel resources. We are not responsible for the content, security, privacy practices, or accuracy of external websites.
18. Privacy and Data Protection
Your use of our website and services is also governed by our Privacy Policy. Kenya’s Data Protection Act, 2019 regulates the processing of personal data and provides rights and obligations for data subjects, data controllers, and processors.
19. Governing Law
These Terms of Service shall be governed by the laws of Kenya, unless otherwise required by applicable consumer protection or travel laws.
